Using AI with X12 Standards: What’s Allowed, What’s Not, and Why It Matters

Artificial intelligence (AI) is moving fast—much like the Wild Wild West. Like the lawless, untamed American frontier during the 19th century, new AI capabilities (and new risks) seem to appear overnight as rules are being written—and rewritten. Conversations abound about how AI-powered systems should (and shouldn’t) interact with creative and proprietary content.

To be sure, certain use of X12 Standards materials with AI can be a “win-win-win” for X12, licensees, and end users. For example:

  1. Trading partner–specific map building: AI systems can help licensing partners and their customers build or update maps faster to onboard additional trading partners more quickly.
  2. Real-time monitoring of trend shifts: AI systems can monitor for changes that trigger alerts, such as inventory or order changes.

In recognition of the potential benefits of AI, during the General Session at X12’s Winter 2026 Standing Meeting in January, CEO Cathy Sheppard underscored that X12 supports—and has expressly authorized in its licenses—AI uses that:

  1. Benefit the X12 Standards ecosystem, and
  2. Respect intellectual property (IP) and contractual protections

Upholding the integrity of X12 Standards and the value they provide across industries is critical to X12. Protecting the integrity of X12 Standards, however, also means that certain AI uses are prohibited.

Here’s a practical overview of what our licenses mean in practice for how AI can—and cannot—be used with X12 Standards and related materials. You can access the presentation deck in the X12 Info Center.

Why X12 Cares So Much About AI + IP

X12 owns the copyrights to the X12 Standard and related materials and has dozens of registered copyrights in these materials that strengthen its ability to enforce its rights, if needed. That enforcement point isn’t hypothetical or just legal boilerplate. Copyright law grants owners—like X12—exclusive rights over reproduction, distribution, display, and derivative uses of protected works.

If those rights are violated, remedies can be significant, ranging from statutory damages (up to $150,000 per infringed work) to attorney’s fees, injunctive relief, disgorgement of profits, and even destruction of infringing materials (potentially including AI models trained on/derived from copyrighted works).

Understanding Licensing Basics: “Commercial Use” and “Internal Use”

According to X12’s licenses, “Artificial Intelligence Technology” is defined broadly as machine-based systems that can infer from inputs to generate predictions, recommendations, content, or decisions, and includes large language models and other generative AI systems.

As summarized in the “X12 AI Licensing Cheat Sheet” below, the scope of expressly authorized use of AI differs across the licenses.  Notably, there are important differences between commercial use and internal use.

In plain terms:

  • Commercial Use License: Licensee is allowed to “ground” (give controlled access to data without allowing AI training) the Licensee’s private instance of an AI model on X12 Standard materials to build and operate a value-added software solution licensed to end users—but AI training is not allowed.
  • Internal Use License: Licensee is allowed to “ground” the Licensee’s private instance of an AI model to build and operate an internal value-added software solution that is not accessible to users external to Licensee.  Licensee may also train its private instance of an AI model, but solely for its internal software solution.

X12’s updated licenses introduce clear AI guardrails. Among them:

  • X12 Standards can only be used in a private instance of an AI model.  This means the AI model is only accessible to the licensee and, if applicable, its AI service provider, but only as needed to operate the AI model solely for the benefit of the licensee.  In certain cases, however, X12 licenses authorize the licensee’s end users to interact indirectly with the AI model through the user interface of the X12 licensed software solution.
  • X12 Standards cannot be extracted from AI-enabled end user interfaces for use separate from the value-added software solution.
  • X12 Standards cannot be used to train or ground an AI service provider’s AI model—only the licensee’s private instance of an AI model can ground and/or train on X12 Standard materials, to the extent expressly authorized in the applicable license.  (Did you know: Many AI toolseven enterprise versionstrain on end user inputs, so reviewing AI service provider terms to opt out of training,or other use beyond the scope of your X12 license, is important to comply with your license.)
  • X12 Standards cannot be used in publicly accessible AI deployments, e.g., ChatGPT.
  • X12 Standards may only be used for expressly permitted uses under the applicable license type.
  • X12 Standards cannot be used with AI to create substitutes for the X12 Standard.

If the AI use is not expressly allowed, it is prohibited unless you obtain express written authorization for the new AI use from X12.

X12 AI Licensing Cheat Sheet

X12’s updated licenses expressly allow certain AI use cases that support licensing partners while protecting the integrity of the X12 Standard ecosystem. The table below provides a simplified overview of certain key permitted and prohibited AI uses for each license type. Even so,  licensees should review the full terms of their licenses, which provide more detail and govern in all respects.

A Safe-Operating Mindset for X12 Members and Licensees

If you remember only a few things:

  • Only use X12 Standard materials with your private instance of an AI model, and only for your license’s expressly permitted purposes.
  • Do not copy, paste, or otherwise input X12 Standard materials into publicly accessible AI models or into AI tools that train the service provider’s AI model on user inputs (this may include your company’s internal enterprise AI tools).
  • Take proactive measures to prohibit “extraction” of X12 Standard materials from UI for licensed software solutions.
  • When in doubt, ask X12 for permission—because if an AI use isn’t expressly permitted, it’s prohibited.
